Terms & conditions
These terms govern the use of muldenapp.ch for customers, dumpster suppliers and disposal partners.
1. Scope
These general terms and conditions (the "Terms") govern the use of the muldenapp.ch platform (the "Platform"), operated by Lightnet Multimedia GmbH, Lightnet Multimedia GmbH, 3375 Graben, Switzerland.
They apply to all customers (private and commercial users, the "Customer") and to disposal and dumpster providers (the "Provider") using the Platform.
Deviating or supplementary terms of users apply only to the extent the operator has confirmed them in writing.
2. Role of the Platform (intermediary)
The Platform acts solely as an intermediary. It provides the technical infrastructure, matches customer requests with suitable providers and supports administration.
The Platform is not a contractual party to the dumpster or transport order between Customer and Provider and does not itself perform transport, dumpster placement or disposal services.
Use of the Platform is free of charge for Customers. Customers pay no fees, commissions or other consideration to the Platform operator. The invoice for the dumpster, transport or disposal service is issued directly by the executing Provider to the Customer; the Platform operator does not receive a share of such revenue. The Platform’s sole revenue model is the paid Provider subscriptions set out in section 5.
Where the Platform displays pricing, availability or service information, such information is based on data supplied by the respective Provider and is presented to the best of our knowledge without own warranty.
3. Conclusion of contract
By submitting a dumpster order on the Platform the Customer makes a binding enquiry vis-à-vis a suitable Provider.
The contract for the dumpster, transport or disposal service is concluded exclusively between Customer and Provider as soon as the Provider confirms the enquiry (typically by active acceptance on the Platform or by direct reply to the Customer).
The Platform only confirms receipt of the enquiry and successful matching and is not a contractual party.
4. Platform services
The Platform offers Customers free-of-charge access to placing orders, comparing prices and viewing order status.
For Providers the Platform offers visibility, lead matching, administrative tools and — depending on the subscription booked — additional features. Scope and price of subscriptions (Starter / Pro / Premium) are displayed during the booking process.
The Platform may evolve or restrict features at any time to the extent this does not materially impair the contractual purpose.
5. Prices and payment terms (provider subscriptions)
Provider subscription prices are displayed in Swiss francs (CHF). Unless otherwise stated, prices are shown excluding statutory VAT.
Payment is processed via Stripe (Stripe Payments Europe Ltd., Ireland). By concluding a paid subscription the Provider authorises the Platform to collect recurring amounts in line with the chosen tariff.
If payments fail, the Platform may suspend access to paid features until the amount has been settled in full. Ordinary termination is possible at any time to the next billing period; extraordinary termination for cause remains reserved.
Pure recycling yards (Providers offering exclusively direct drop-off at their own site, without dumpster service through the Platform) are listed free of charge in the public directory. No subscription fee and no matching fee apply. As soon as a Provider also activates dumpster service on the Platform, the provisions of the preceding paragraphs (subscription tariff per chosen plan) apply from that point on.
Dumpster providers can register free of charge and use all platform features for profile maintenance (company data, location, dumpster configuration, prices, zones, materials) without a subscription. Incoming dumpster matches are marked as "subscription required" in this state (teaser only, no customer contact details). As soon as the provider activates a subscription (Starter / Pro / Premium), any pending matches are immediately unlocked and new matches are delivered directly. The billing period begins with successful payment and runs one calendar month. Period fees already accrued are not refunded. Upon cancellation the provider remains entitled to receive matches until the end of the billing period.
6. User obligations
Customers provide truthful order information and select material, dumpster and delivery location as accurately as possible. Inaccurate information that causes additional cost to the Provider may be invoiced directly by the Provider.
Providers keep their company data, services, coverage areas, pricing, opening hours and availability up to date. In the event of absence (holidays, technical outages) the status on the Platform must be updated accordingly.
Abusive use — in particular submitting clearly fake enquiries, automated scraping or attempts to route communication around the Platform — is prohibited and may result in suspension.
7. Right of withdrawal
Under Swiss law, service contracts (including the intermediary service via muldenapp.ch) generally do not carry a statutory right of withdrawal after conclusion of the contract.
Where individual Providers voluntarily grant a cancellation or return right, the respective Provider’s terms apply.
8. Warranty and defects
Warranty claims for the actual dumpster, transport or disposal service are governed by the contract between Customer and Provider and by the provisions of the Swiss Code of Obligations (CO).
Complaints must primarily be raised directly with the executing Provider. On request the Platform supports in establishing contact, but is not itself liable for performance.
9. Liability and availability
The Platform strives for reliable and transparent operations but cannot guarantee uninterrupted availability. Maintenance, security incidents or outages of external providers may cause short-term restrictions.
To the extent permitted by law, liability of the Platform operator for slight negligence is excluded. In case of gross negligence or intent, statutory provisions apply. Liability for personal injury and mandatory statutory liability remain unaffected.
Each Provider is responsible for its own offer content, prices and the execution of the service within the applicable legal framework.
10. Privacy
The processing of personal data is governed by the separate privacy policy available at /datenschutz.
11. Changes to the Terms
The Platform may amend these Terms where required for operations, legal certainty, new features or adjusted pricing models. Changes are announced at least 30 days prior to entry into force, and registered users additionally receive an e-mail notification.
If a user does not object within the announcement period and continues to use the Platform, the amended Terms are deemed accepted.
12. Governing law and jurisdiction
Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-laws rules.
The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is — to the extent permitted by law — Bern, Switzerland. Mandatory places of jurisdiction for consumers under Swiss law remain reserved.
13. Final provisions
Should any provision of these Terms be invalid or unenforceable, the remaining provisions remain unaffected. The invalid provision shall be replaced by a regulation that most closely matches the economic purpose.
